Terms and Policies
Terms of service, privacy, cookies, accessibility, fair housing and agent disclosures for chadnolan.homes in one place.
Effective date: October 22, 2026
Terms of Service
These Terms of Service (the "Terms") form a binding agreement between you and Chad Nolan ("Chad," "we," "us" or "our"), the Designated Broker and Owner of 1 Percent Lists Tacoma. They govern your access to and use of chadnolan.homes and every page, calculator, form and feature on it (together, the "Site"). By using the Site you accept these Terms and the other policies on this page. If you do not accept them, do not use the Site.
Please read these Terms with care. The Governing Law and Disputes section sets the courts where a dispute can be heard. The Disclaimer of Warranties and Limitation of Liability sections limit liability to the extent Washington law allows.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site. By using it you confirm both.
2. General Information Only
The guides, FAQ answers, calculators, review pages and every other page on the Site share general information about real estate in Washington. Nothing on the Site is legal, tax, lending, insurance, inspection, appraisal or financial advice. Nothing on the Site is a broker price opinion or a comparative market analysis of your property. Laws, interest rates and market conditions change and a page can fall behind them. Speak with a qualified attorney, accountant, lender or inspector about your own situation before you act.
3. No Agency Relationship From Using the Site
Browsing the Site, using a calculator, sending the contact form, calling or emailing does not make Chad your agent. It does not create a client relationship, a fiduciary duty or any other duty owed to you. Representation begins only under a written services agreement signed by you and the brokerage, as described in Agent Disclosures.
Information you send before that agreement is not confidential client information. Hold back details you would not want shared with someone who could represent the other side of a transaction.
4. Calculators and Estimates
The savings calculator compares a 1% listing fee with an example 3% listing fee on the price you enter and shows agent listing fees only. The mortgage payment and amortization calculators estimate payments, interest and loan balances from the figures you enter. Unless a field names them, they leave out real estate excise tax, escrow, title, lender fees and other closing costs.
Every result is an estimate. The figures are not a loan offer, a rate quote, a loan approval or a promise of what you will pay or receive. Your lender, your agreement and your final settlement statement set the real numbers.
5. Figures and Statistics
Figures such as years licensed, sale volume, ratings and review counts show the source and date named where they appear and can change after publication.
6. Reviews and Testimonials
Client reviews on the Site come from public reviews on Google, Zillow and Facebook and appear as the reviewers wrote them. Star ratings and review counts show each source on the date shown. A review describes one client's experience and does not promise the same result for anyone else.
7. Acceptable Use
You agree not to do any of the following.
- Copy, scrape, harvest or index Site content with bots, scripts, crawlers or other automated tools, other than general search engines and AI search services that follow robots.txt
- Republish photos, reviews or page text without written permission from their owners
- Send spam, malware, false information or another person's contact details through the contact form
- Try to get around, disable or interfere with the Site's security features or its spam check
- Frame or mirror the Site or present its content as your own
- Upload or send viruses, spyware or other harmful code
- Place an unreasonable load on the Site or the networks that serve it
- Impersonate anyone or misstate your connection to anyone
- Use the Site to harass anyone or to discriminate in violation of fair housing law
- Use the Site in any way that breaks a federal, state or local law
8. Intellectual Property
The Site and its text, design, layout, graphics, logos, calculators, code and original photos (the "Content") belong to Chad Nolan or are used under license and are protected by United States copyright and trademark law. The 1 Percent Lists name and logo belong to their owner and appear with permission. Other marks, such as Zillow, Google and Facebook, belong to their owners and appear only to name where a review or profile lives.
You may view the Site and print pages for your own personal, noncommercial use. Any other copying, reproduction, distribution, modification or commercial use needs Chad's written permission. All rights not expressly granted in these Terms are reserved.
9. Copyright Complaints
If you believe content on the Site infringes your copyright, send a written notice to the details in the Contact section that includes the following.
- Your physical or electronic signature
- A description of the copyrighted work
- The link to the page with the material you believe infringes it
- Your name, mailing address, phone number and email
- A statement that you believe in good faith the use is not authorized by the copyright owner, its agent or the law
- A statement, made under penalty of perjury, that your notice is correct and that you own the copyright or are authorized to act for the owner
A notice that knowingly misstates infringement can make the sender liable for damages under 17 U.S.C. § 512(f).
10. Third Party Sites and Services
The Site links to and works with services run by others, including Zillow, Google, Facebook, YouTube, Instagram, TikTok, LinkedIn, U.S. News and the 1 Percent Lists Tacoma website. Those services run under their own terms and privacy policies. Chad does not control them and is not responsible for their content or practices. Visiting a linked site is at your own risk.
11. Disclaimer of Warranties
The Site is offered "as is" and "as available." To the fullest extent the law allows, Chad disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and noninfringement. Chad does not promise the Site will be correct, complete, uninterrupted, secure or free of errors or viruses.
12. Limitation of Liability
To the fullest extent the law allows, Chad Nolan, 1 Percent Lists Tacoma and their brokers, employees and agents are not liable for any indirect, incidental, consequential, exemplary or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or related to your use of the Site or your reliance on its content, even if told such damages were possible. Total liability for all claims related to the Site is limited to one hundred U.S. dollars (US $100).
Nothing in these Terms limits liability that cannot be limited under Washington law, including liability for gross negligence or intentional misconduct. Nothing in them changes the duties owed to a client under a signed agreement or chapter 18.86 RCW.
13. Indemnification
You agree to defend, indemnify and hold harmless Chad Nolan, 1 Percent Lists Tacoma and their brokers, employees and agents from all claims, losses, damages and expenses, including reasonable attorney fees, arising from your breach of these Terms, your misuse of the Site or your violation of another person's rights or of any law.
14. Electronic Communications and Text Messages
Sending the contact form, emailing or texting counts as communicating electronically. You agree that notices, disclosures and agreements sent electronically meet any legal rule that they be in writing, to the extent the law allows.
When you send the contact form and check the consent box you agree to be contacted about your real estate inquiry by phone, email or text at the details you gave. Consent to texts is not a condition of buying any property or service. Message frequency varies with your inquiry. Message and data rates from your carrier may apply. Reply STOP to end texts or HELP for help. Marketing texts and marketing emails need your separate permission and every marketing email includes a way to unsubscribe.
15. Governing Law and Disputes
Washington State law governs these Terms and any dispute about the Site, without regard to conflict of law rules.
Before filing a claim, contact Chad using the details in the Contact section with a written description of the issue. Both sides agree to try to resolve it informally for at least 30 days. If the issue stays unresolved, any claim will be heard only in the state or federal courts located in Pierce County, Washington and you agree to the personal jurisdiction of those courts.
16. Changes, Availability and Termination
Chad can change, suspend or remove any part of the Site at any time without notice and does not promise the Site will always be available. These Terms can change too. The effective date at the top of this page shows the current version and using the Site after a change means you accept the updated Terms.
Chad can block or end your access to the Site at any time if you break these Terms. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, survive the end of your access.
17. California Users
Under California Civil Code Section 1789.3, California users can reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by phone at (800) 952‑5210.
18. General Terms
These Terms and the policies on this page form the entire agreement between you and Chad about the Site. If a court finds part of them unenforceable, that part is limited or removed as little as needed and the rest still applies. Not enforcing a term is not a waiver of it. You may not assign your rights under these Terms. Chad can assign them, including to a successor brokerage. Neither side is liable for delays caused by events beyond its reasonable control. Section headings are for convenience only.
Privacy Policy
This Privacy Policy explains what personal information Chad Nolan collects through the Site, how Chad uses and shares it, how long Chad keeps it and the choices and rights you have. It covers the Site only. Information you give Chad as a client is also governed by your written agreement and Washington real estate licensing law.
Information You Give
The contact form asks for these details.
- First and last name (required)
- Email (required)
- Phone number (optional)
- What you are interested in, such as selling, buying or a home valuation (required)
- A message (required)
- Your consent to be contacted by phone, email or text about your inquiry (required)
You can also share information when you call, text, email or message Chad on social media. Do not send Social Security numbers, bank or card numbers or other sensitive financial details through the form or by email.
Information Collected Automatically
When you visit, the network that serves the Site processes your IP address, browser, device, operating system, the page you came from, the pages you load and the time of each visit. That processing is needed to deliver pages, keep the Site secure and block attacks.
Visit statistics come from Cloudflare Web Analytics. It counts page views, referring sites, browsers and countries without cookies and without building a profile of you.
Information the Site Does Not Collect
The Site has no user accounts or logins, takes no payments and runs no advertising, retargeting or tracking pixels. It does not use browser fingerprinting. It does not collect consumer health data as defined in Washington's My Health My Data Act (chapter 19.373 RCW) or precise geolocation.
How Information Is Used
- To answer your question and follow up on the real estate help you asked for
- To prepare for and deliver real estate services if you become a client
- To keep the Site working, secure and free of spam and abuse
- To understand in total numbers which pages visitors find useful
- To meet legal, licensing, tax and record keeping duties and to protect legal rights
Personal information is not used for automated decisions with legal or similarly significant effects and is not used to train artificial intelligence models.
How Information Is Shared
Chad does not sell personal information and does not share it for cross context behavioral or targeted advertising. Chad shares it only in these cases.
- With service companies that run the Site's servers, deliver form messages, check forms for spam and run email. They can use it only to deliver their service.
- With 1 Percent Lists Tacoma, the brokerage, when needed to deliver services or keep records the law calls for.
- With lenders, escrow and title companies, inspectors, appraisers or other agents in a transaction when you ask or your agreement calls for it.
- When the law, a subpoena, a court order or a licensing authority calls for it, or to protect the rights, property or safety of Chad, clients or others.
- With a successor if the business or brokerage is sold or merged, under the protections in this policy.
Mobile phone numbers and text messaging consent are not shared with third parties or affiliates for their marketing or promotional purposes.
How Long Information Is Kept
Contact form messages and emails are kept as long as needed to answer you and stay in touch about the real estate goals you shared. Records tied to a real estate transaction are kept as long as Washington licensing law and the brokerage's record rules call for. Information no longer needed is erased.
How Information Is Protected
The Site runs only over encrypted HTTPS connections with HTTP Strict Transport Security and a strict content security policy. Form messages travel encrypted to the form service and email provider. Access to inquiries is limited to Chad and the people who help deliver services. No method of storage or transmission is completely secure and absolute security cannot be promised.
Children
The Site is meant for adults and is not directed to children. Chad does not knowingly collect personal information from anyone under 18. If you believe a minor sent information through the Site, contact Chad and it will be erased.
Your Privacy Rights
Wherever you live you can ask Chad to do any of the following.
- Confirm whether personal information about you is held and give you a copy
- Correct information that is wrong
- Erase it, except records the law calls for keeping
- Stop marketing emails or texts at any time
Residents of states with consumer privacy laws, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, can hold these rights by law. Chad honors them for every visitor, covered by a state law or not.
Send rights requests using the details in the Contact section. Chad answers within 45 days, confirms your identity using contact details already on file and will not treat you differently for using these rights. If Chad turns down what you asked for, you can appeal by replying to the decision. If the appeal is denied you can contact your state attorney general. An authorized agent can act for you with your signed permission.
Do Not Track and Global Privacy Control
The Site does not sell or share personal information and a browser privacy signal has nothing to opt out of. The Site honors Global Privacy Control signals as a valid opt out anyway. No uniform standard exists for Do Not Track signals and the Site does not change how it works when it receives one.
California Shine the Light
Personal information is not shared with third parties for their direct marketing purposes.
Changes to This Policy
When this policy changes, the effective date at the top of the page changes with it. Material changes are noted on this page.
Cookie Policy
Cookies are small text files a website stores in your browser. Local storage, session storage and tracking pixels do similar jobs. This policy covers each of them.
Cookies Set by the Site
None. chadnolan.homes does not set its own cookies and does not store anything in your browser to follow you.
Cookies From Other Services
Some services on the Site can set their own cookies.
- Hosting and security. Cloudflare can set a short lived, strictly necessary security cookie to tell people from bots and stop attacks. It holds no profile of you.
- Spam checks. The contact page loads hCaptcha. It can set cookies or read similar browser data to confirm a person is sending the form. It loads on the contact page only and runs under the hCaptcha privacy policy and terms.
- Links to other sites. Social media and review sites set nothing on the Site. They can set cookies after you follow a link to their own sites.
Managing Cookies
Every major browser lets you view, block and clear cookies in its settings. Blocking cookies does not affect reading the Site. The contact form spam check may not work with every cookie blocked. If that happens, call or email Chad instead.
Accessibility Statement
Chad Nolan wants every visitor to be able to use the Site, including people who use screen readers, keyboard navigation, magnification, captions or voice control.
Standard
The Site is built to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA, the benchmark most often used for web accessibility under the Americans with Disabilities Act.
What Is in Place
- Text and backgrounds checked against WCAG contrast ratios
- Alternative text on meaningful images and empty alternative text on decorative ones
- One main heading per page with headings in order
- A page language set for screen readers
- Menus, links and form fields that work with a keyboard
- Visible labels on contact form fields
- Pages that zoom to 200% and fit a phone screen without sideways scrolling
- Tap targets at least 44 pixels on small screens
Known Limitations
- The spam check on the contact form comes from an outside service. If it blocks you, call or email instead.
- The amortization charts in the buyer and seller calculators can be hard to follow with a screen reader. The same figures appear in the year by year table under each chart.
- Review platform links open Google, Zillow and Facebook. Those sites run their own accessibility work.
Feedback and Help
If any part of the Site is hard to use, contact Chad using the details in the Contact section with the page link and what happened. Chad will get you the information another way and have the page fixed.
Assessment
The Site was reviewed against WCAG 2.1 Level AA with automated testing and manual checks in October 2026.
Fair Housing
Chad Nolan and 1 Percent Lists Tacoma are committed to equal housing opportunity. Chad follows the federal Fair Housing Act, the Washington Law Against Discrimination (chapter 49.60 RCW) and local fair housing ordinances in every listing, showing, offer and conversation.
Protected Classes Under Federal Law
The Fair Housing Act prohibits discrimination in the sale, rental or financing of housing because of race, color, religion, sex, national origin, familial status or disability.
More Protections in Washington
RCW 49.60.222 adds creed, citizenship or immigration status, sexual orientation, gender identity, marital status, families with children status, honorably discharged veteran or military status, disability as Washington law defines it and a person with a disability using a trained dog guide or service animal. Washington law also makes it illegal to retaliate against anyone who files a complaint.
More Protections in Tacoma
For homes inside Tacoma, the city's fair housing law also protects ancestry, age over 40 and paying with a Section 8 certificate or other alternative sources of income.
What This Means in Practice
- Every client gets the same service, information and access to homes
- Chad will not steer buyers toward or away from a neighborhood based on who lives there
- Chad will not follow an instruction from a seller or property owner to discriminate
- Listing descriptions describe the property and never the kind of person who should live there
- People with disabilities can ask for reasonable accommodations at any stage
Filing a Complaint
If you believe you faced discrimination in housing, you can file a complaint within one year of the incident with any of these agencies.
- The U.S. Department of Housing and Urban Development, Office of Fair Housing and Equal Opportunity, at 1‑800‑669‑9777 or through hud.gov
- The Washington State Human Rights Commission at 1‑800‑233‑3247 or through hum.wa.gov
- The City of Tacoma Office of Equity and Human Rights for homes inside Tacoma
You can also report a concern about a real estate licensee to the Washington State Department of Licensing. It licenses and oversees real estate brokers in the state.

Licensing
Chad Nolan is the Designated Broker and Owner of 1 Percent Lists Tacoma, a real estate firm licensed in Washington. 1 Percent Lists Tacoma is an independently owned franchise of the national 1 Percent Lists brand. Any Washington real estate license can be confirmed with the Department of Licensing.
Agency
Under RCW 18.86.020 a brokerage must sign a written services agreement with a buyer before or as soon as reasonably practical after its broker starts working for that buyer. Sellers are represented under a written listing agreement. Before you sign either one Chad gives you the state pamphlet The Law of Real Estate Agency and asks you to sign an acknowledgment that you received it. The pamphlet explains the duties a broker owes to clients and to other parties in a transaction.
If Chad or another broker at 1 Percent Lists Tacoma would represent both the buyer and the seller in the same transaction, that happens only with written consent from both clients. Under RCW 18.86.060 that consent is also separately initialed in each services agreement.
Commissions
Commissions are not set by law or by any industry standard and are fully negotiable. Washington law calls for the terms of compensation to be written into the services agreement (RCW 18.86.080). Chad's listing fee is 1% of the sale price as agreed in a written listing agreement. Compensation for a buyer's broker is a separate decision agreed in writing.
